After the implementation of POCSO, courts have seen a reduction in the number of cases, but the volume of unreported cases highlights the magnitude of the problem. Once again, considering the seriousness of this matter, the Ministry of Education has directed all States and Union Territories to implement the "Guidelines on School Safety and Security-2021" to improve child protection in educational institutions. This directive is in response to Supreme Court orders in Writ Petitions (Criminal) No. 136 of 2017 and (Civil) No. 874 of 2017.
The rules, which align with the Protection of Children from Sexual Offences (POCSO) Act, seek to guarantee clear accountability for school management in government, government-aided, and private schools. They include essential components such as preventive education, reporting procedures, legal frameworks, support services, and establishing a safe learning environment. Unequivocally, both private and government institutions have the responsibility to measure high standards of safety and security in schools.
Initially released on October 1, 2021, the "Guidelines on School Safety and Security-2021" are advisory and offer states flexibility to adapt them to local needs, with a strong emphasis on a 'Zero Tolerance Policy' for any lapses in child safety. These guidelines aim to educate all stakeholders, students, parents, and school staff on the importance of creating a safe and secure learning environment for children's overall development. They focus on raising awareness about existing safety-related acts, policies, and procedures, covering physical, socio-emotional, cognitive, and disaster-specific safety measures.
In the implementation of safety measures and guaranteeing accountability, these guidelines outline the roles of each stakeholder, teachers, principals, and school administration are in charge of the safety procedure in private schools, while at government and government-aided schools the Head of school, teachers and the education administration are responsible for ensuring safety and security, especially in school transportation.
