NCPCR Guidelines Zero Tolerance for Negligence Delhi's Commitment to Child Safety

The National Commission for the Protection of Child Rights (NCPCR) has formulated guidelines for the Directorate of Education in Delhi to ensure the safety and security of students. These guidelines instruct all school heads, whether in government, government-aided, or private institutions, to take collective responsibility for safeguarding school children. These steps will create a safe and nurturing learning environment for students to grow.

The Ministry of Education has also introduced the Guidelines on School Safety and Security 2021, which aligns with the Supreme Court’s directives and the National Education Policy, 2020. School heads must ensure that their institutions are prepared according to the safety inspection checklist provided in the NCPCR manual and adhere to the guidelines issued by the National Disaster Management Authority (NDMA) for hostels in educational institutions.

A crucial purpose of the guidelines is to underscore a ‘Zero Tolerance Policy’ towards any negligence by individuals or management regarding the safety and security of children in schools. This policy aims to foster an understanding among all stakeholders, including students and parents, about the importance of co-creating a safe and secure school environment that supports the holistic development of children. It also seeks to inform various stakeholders about existing acts, policies, procedures, and guidelines related to safety and security, covering physical, socio-emotional, and cognitive aspects, as well as measures specific to natural disasters. Additionally, the guidelines intend to empower stakeholders and clarify their roles in their implementation.

Finally, the guidelines establish accountability for ensuring the safety and security of children in schools. This responsibility falls on school management, principals, and teachers in private and unaided schools, while it rests with the head or in-charge of the school, teachers, and the education administration in government and government-aided schools.

Fixing accountability for children's safety and security in schools is crucial as children spend about half their day at school, and the responsibility for their well-being rests with the school authorities. When a child is on school grounds, the institution has direct control over the child and if the school neglects its duties in a way that causes unnecessary mental or physical suffering, it could be seen as a violation of the Juvenile Justice Act, 2015. Therefore the responsibility falls on school management, principals, and heads of schools to ensure that children are safe.
