The University of California, Berkeley, has recently come under scrutiny from US authorities regarding concerns over its foreign funding disclosures. Following a similar investigation into Harvard University, the US Department of Education has now issued a 'Notice of Investigation and Records Request' to examine Berkeley’s financial reporting. In its subsequent responses, dated 16 June and 7 July 2023, Berkeley admitted to failing to report millions of dollars in foreign government funding, as required under Section 117. The university also outlined its efforts to strengthen ties with foreign government-controlled entities and secure financial commitments. However, its responses revealed a fundamental misunderstanding of its obligations under the disclosure regulations. In light of these findings, US Secretary of Education Linda McMahon directed the Office of General Counsel (OGC) to reassume responsibility for enforcing Section 117 disclosures.
Previously, under the Biden Administration, the enforcement of foreign funding disclosures had reportedly shifted from the OGC to the Office of Federal Student Aid (FSA). However, under the Trump Administration, these duties have been reassigned to the OGC, reflecting a renewed emphasis on Section 117 enforcement. Aligned with this shift, President Trump is said to have signed an Executive Order aimed at increasing transparency regarding foreign funding in US higher education institutions. The order instructs the Secretary of Education to reverse actions taken by the previous administration that permitted universities to conceal details of foreign contributions. Furthermore, it mandates full disclosure of the source and purpose of these funds to ensure greater accountability.
